Scott Cameron Baxter T/A Scott Cameron Baxter Photography provides access to the Scott Cameron Baxter website, www.scottcameronbaxter.com and sell selected products to you subject to the conditions set out below. Please read these conditions carefully before using the Scott Baxter website. By using the www.scottcameronbaxter.com website, you signify your agreement to these conditions.
Scott Cameron Baxter Photography reserves the right to refuse access to the online purchasing facilities offered on the website, edit or remove products, or cancel orders at our discretion. Any cancelled orders will not incur any cost to you. You understand that you, and not Scott Cameron Baxter Photography, are responsible for all electronic communications and information sent from your computer to us and you must use the website for lawful purposes only. You must not use the website in any way that may be deemed fraudulent or be unlawful in any other way.
Returns and Cancellations
Due to the nature of the products on sale, all sales are final. All items are inspected personally by Scott and replacement(s) of goods will only be provided if the original artwork is returned.
Pricing and Availability
The majority of prints are ordered on demand, although some stock is held. If you have ordered from the Exhibition or Limited Edition items, these are printed to order and can take up to 7 days before they are dispatched. Although, they are often dispatched much sooner. Framed and Limited Edition prints can take up to 10 days for delivery from the date your order was confirmed. You will be kept advised of the process of your order but you may contact us at any time for a status update by contacting us on the website www.scottcameronbaxter.com
Errors
Despite our efforts, it is possible that occasionally products on our website may be mis-priced. All prices are verified when we confirm your order. If a product’s correct price is lower than the stated price, we will charge you the lower amount. If a product’s correct price is higher than our stated price, we will at our discretion, confirm your order at the lower price, contact you for instructions before confirming your order, or cancel your order and notify you of the cancellation.
Age Restrictions
Scott Cameron Baxter Photography do not sell products for purchase by children. We do sell products that may be purchased for children by adults. If you are under 18, you may purchase from this website only with the involvement of a parent or guardian.
Events beyond Our reasonable Control
Scott Cameron Baxter Photography will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause, which is beyond our reasonable control. This condition does not affect your statutory rights.
Alterations and Amendments
We reserve the right to make changes to our website, policies and these Conditions of Use and Sale at any time. If any of these conditions is deemed for any reason unenforceable, that condition will be deemed severable and will not affect the validity of any remaining conditions.
Commercial Use
My images may be licensed for commercial use. If you are ordering multiple images, or would like a rights-managed agreement, I will provide details by email – use the contact me section to discuss your requirements https://www.scottcameronbaxter.com/contact/
Examples of commercial use include: Web pages, magazines, products, computer / tablet / phone applications, forms of advertising including print and web, competitions for profit.
License fees will vary depending on the use, but generally fall between £50 and £500 depending on the image, where the image will be published and how long for.
Non-Profit Use

Press Releases

Artwork
Prior permission is required to copy all or parts of my photographs in artworks. You will require a formal licensing agreement.
Social Media – Commercial
Use of my photographs in social media (Facebook, Instagram, Twitter, blogs etc.) is the same as Commercial use and requires a licensing agreement.
Social Media – Personal
People acting in a personal capacity are welcome to share my photographs on blogs, web pages, and social media accounts without prior permission, provided that all images are accompanied by a link back to www.scottcameronbaxter.com
Copyright Infringement Policy
I have many copyright infringements every year. The above is an attempt to provide clarity regarding the use of my work.
All images are owned by Scott Cameron Baxter and all rights are reserved.
What are the consequences of copyright infringement?
*The user of the image may be asked to purchase a licence, and a commercial arrangement might be reached after which no further action is taken. However, legal action might be taken by bringing a claim in court which could result in having to go to court for a hearing. Court cases can be expensive, as they often result in the user of the image paying the cost to use the photo, plus legal costs of themselves and the copyright owner and possibly other financial compensation for copyright infringement, which may amount to more than the cost of a licence to use the image.

Law
All contracts between you (the buyer) and Scott Cameron Baxter Photography (the seller) shall be governed by the laws of Scotland. You agree, as we do, to submit to the jurisdiction of the courts of Scotland.
